2.2 Dewberry reserves the right to edit copy or amend the layouts or photographs supplied, should it be considered necessary.
2.3 Dewberry reserves the right, at its discretion, to amend and edit copy entered into the Dewberry online database by advertisers.
2.4 Dewberry reserves the right, in its sole and absolute discretion to determine the categorisation and positioning of each advertisement within the Dewberry directory.
2.5 Dewberry cannot be held responsible for any loss or damage resulting from any changes made to the photographs and copy submitted by the advertiser.
2.6 Dewberry, in its sole discretion, before considering any other criteria in determining whether to accept or decline an advertiser’s site link for inclusion in the Dewberry directory, stipulates that the site submitted by the advertiser must meet the following minimum criteria:
4.2 Every effort will be made to reproduce faithfully all advertisements submitted, but Dewberry cannot be held responsible for any loss or damage or otherwise resulting from errors or omission.
5.2 In no event shall Dewberry be liable to the advertiser for any special, consequential, incidental or indirect damages, including lost profits.
6.2 Dewberry shall be entitled to reproduce part or whole of any photographic material supplied by the advertiser.
6.3 It is the advertiser's responsibility to obtain reproduction permission for all photographic and other material used in their advertisements. The advertiser warrants that he is the owner of the copyright in such material or is authorised by the owner thereof to grant to Dewberry the rights therein contained. Dewberry cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers and the advertiser indemnifies Dewberry against any action brought for breach of copyright or other rights from the use of such material supplied by the advertiser.
6.4 Dewberry cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers.
9.2 Dewberry reserves the right to refuse any advertisement for Dewberry and will not be liable for any loss or expense in so doing.
9.3 If an advertiser attempts to enter unsuitable material into the Dewberry online database, or persistently misuses the online systems, Dewberry reserves the right to remove the advertisement from the Dewberry web site. No refunds will be paid.
10.2 Advertisements placed via the Dewberry online payment system will normally be activated within 24 hours of payments being successfully processed
12.1 Dewberry maintains information about the Advertiser on the Dewberry servers, including but not limited to the Advertiser’s registration information. The Advertiser agrees and acknowledges that Dewberry may use such information in aggregate form for research and development, marketing, or other promotional purposes. The Advertiser agrees that Dewberry has the right (but not the obligation) to disclose any such information, to the extent necessary, if Dewberry reasonably believes that such disclosure is required to comply with any law or to take action to enforce this Agreement.
12.2 Dewberry may contact the Advertiser regarding the Dewberry services using the Advertiser’s email address provided during the registration process (or as updated by the Advertiser). Such email messages may contain opportunities regarding special offers and new products or services from Dewberry.
12.3 Dewberry considers Internet user privacy and data protection to be of paramount importance. Dewberry complies with the Data Protection Act 1998 in relation to all processing of personal data supplied to us by our users and other personal data in our possession for any reason. Dewberry has notified the Data Protection Commissioner of our practice affecting personal data.
